Somalia…Somalia Make It Victorious, Oh Muslims!

The following is a translation from Arabic.

Ethiopia brought in her army, by land and by air, in a criminal aggression upon the Muslims of Somalia and announced this intervention after having done it before without any announcement. Her reason this time being self-defence, that is, the defence of Ethiopia, but where? In Somalia!?

The war in Somalia is persisting and accelerating, between the heavily armed Ethiopian army, supported internationally, politically and militarily, by America and regionally by American agents in Africa, and the Muslims of Somalia, being led by the recently established and relatively inadequately-armed Islamic Courts. Yet the rulers in the Muslim lands are deaf, dumb and blind to the situation as if what is occurring is in a far-off land and not in an Islamic land which has a glorious past, occupies an important strategic position, and entered into Islam very early, with some of its people entering Islam when some of the Companions migrated to Abyssinia in the early phase of the da’wah in Makkah. The land was subsequently opened in 77 AH during the time of Abd al-Malik and remained an Islamic land connected to the Muslim lands, particularly Yemen which faces it across the Gulf of Aden. Towards the end of the Uthmani era, it was afflicted by the greed of the disbelieving colonial states which inflicted all the Muslim lands.

O Muslims,

America and her agents in the Horn of Africa, with the Ethiopian regime at their head, were shocked when the saw the people of Somalia coming together around the Islamic Courts. They feared that this power may unite Somalia in the name of Islam, ruining their plans for the region:

As for Ethiopia, it has occupied two regions from the land of Somalia (Ogaden and Hud) and it fears any stable and strong power in Somalia. It particularly fears any unity of the people in the name of Islam as this would move the issue of the two regions and their return to Somalia.

As for America it has not ceased yearning for the long years in which it had control in Somalia, that is, during the reign of Siad Barre which remained until 1991 when the armed clans removed him, flipping the balance in the America-British struggle in favour of Britain, whereafter America lost control and instability took hold. Britain moved quickly to its previous mandate (British Somaliland) and announced the establishment of the independent ‘Republic of Somaliland’ in the same year, leaving the rest of Somalia and its people in instability. America tried, in 1992, to return her influence once again under the pretext of humanitarian efforts, calling their endeavor ‘Operation Restore Hope’ and gathering for it some 28 thousand troops. However it failed and had to pull out in shame in 1995.

Yet America has not left its desire for control and influence in the Horn of Africa. She worked to fail, through the formation of the government of Abdul Qasim Salad, the Djibouti agreement of 2000, because Europe was behind it and because it did not include (as America wanted) a provision for the immediate dissolution of the independent republic of Somaliland (formerly a British protectorate). After having caused the failure of the Djibouti agreement, America consolidated her plans and agents in the region through the agreement of Nairobi toward the end of 2004, via the formation of a temporary government headed by their puppet Abdullahi Yusuf - who was the president of the independent statelet of Puntland which was announced in 1997 - and began to prepare this government to act as the official representative of Somalia regionally, in regional organisations such as the African Union and the Arab League, and internationally in the United Nations. At the same time America continued its support of the warlords in Mogadishu, moving to the achievement of its interests in two parallel ends: politically through the establishment of the temporary government and militarily by supporting the warlords. However the corruption of the temporary government and its blatant puppetry to America and Ethiopia, as well as the continued conflict amongst the warlords and the resultant destruction, made the people of Somalia look toward whom would rescue them from their dire situation. They turned their attention to the Islamic Courts when the warlords, backed by America, sought to finish them. The people supported the Courts and gave them victory over the warlords. The people were familiar with the Courts whom had solved many of their problems on a voluntary basis since 1994 during a period of lawlessness; they noticed their sincerity for Islam and so assisted them. Allah gave them victory over the warlords, who fled terrified and America benefited naught from them. The people began joining the Courts, even before the men of the Courts would reach their towns and villages.

America returned thereafter to its usual weapons: cunning negotiations and state-backed terrorism used to penetrate Somalia. As for the first, it assigned it to Sudan, who worked to bring together the Courts with the temporary government in Khartoum for negotiations and the proposing of ‘moderate’ solutions, with the purpose of reviving the all but dead temporary government which was incapable of even securing its own centre (Baidoa) and was hated by the people, and with the purpose of reducing the Courts to a mere local power like others in Somalia, for the temporary government to then take overall control. As for the second, it assigned it to Ethiopia to militarily enter Somalia and protect the temporary government from the Islamic Courts. Ethiopia had began this much earlier, and has only announced it publicly now.

O Muslims,

The fighting in Somalia is between the Muslims of Somalia and disbelieving Ethiopia, being supported by America, who is planning, financing and supporting the war for three reasons:

1. The Somali people being Muslim and loving their Islam, wanting to come together in its name, under the leadership of the Islamic Courts. America fights any Islamic movement wherever it can. It detests Islam and its people, particularly those who do not conform to what its calls ‘moderate Islam’, as if there were a moderate Islam and an extreme Islam. May Allah curse them, how they lie!

2. Somalia has a strategic position on the Indian Ocean with the longest shore (reaching 2720km) from any African state. Its shores form to extended arms: from the eastern side of Somalia upon the Indian ocean and from the northern side upon the Gulf of Aden, in front of the Bab al-Mandeb of the Red Sea. Thus it position controls the Horn of Africa in such a way that it makes Somalia a launching point, nay the controlling point, in Southern Africa and the Arabian Peninsula.

3. The land of Somalia is a virgin land with regards to its resources. According to studies it holds reserves of uranium, natural gas, petroleum and other natural resources. Towards the end of the 80s, in the time of Siad Barre, the rights of exploration were given to American petroleum corporations who found rich reserves of petroleum, the presence of which was verified even before this by geologists from the International Bank. However the coup which removed Siad Barre brought a stop to the exploitation of these resources, and today America runs towards this natural wealth impatiently.

O Muslims,

America considers herself to be the judge over the entire world and that she owns all the natural wealth within the Earth and upon its surface. Her arrogance blinds her from her consequent failures since Vietnam to Afghanistan and Iraq, even in Somalia itself in 1995. She does not stop searching for those who will compensate her for her defeats and humiliations. She thinks that her agent regime in Ethiopia will return to her something of reputation. The Islamic Courts are a newly establish force with imbalance of men and artillery relative to the well-armed Ethiopian army, yet the Muslims and the men of the Courts are displaying amazing heroism in the face of this aggression. This is the case in all the rounds of the Muslim fighters fighting against the forces of the disbelievers and the hypocrites; however the silence of the Muslims from giving victory to their brothers only emboldens kufr and the kuffar in their aggression upon the Muslim lands, one after the other. This silence and lack of action is not pleasing to Allah, nor to His Messenger, nor to the believers; for we are one Ummah, one body, as the Messenger (saw) described us:

«كالجسد الواحد إذا اشتكى منه عضو تداعى له سائر الجسد بالحمى والسهر»

“…like one body, when one part of it feels pain, the rest of the body is afflicted with fever and sleeplessness.”

Indeed America and with her Ethiopia are warring states, and should be dealt with, by the established states in the Muslim lands, on this basis, that is, on the basis of immediate war. Cutting all diplomatic relations with them is obligatory. There should be no embassies, no treaties or agreements, nor any alliances…and if this is not done, we will be afflicted with that which afflicted those nations before us who disobeyed the command of their Lord: disgrace and humiliation in this world and a painful torment in the hereafter.

O Muslims,

Hizb ut-Tahrir urges you to give victory to Somalia; this is an obligation, commanded by Allah, the Exalted:

وَإِنِ اسْتَنْصَرُوكُمْ فِي الدِّينِ فَعَلَيْكُمُ النَّصْرُ

"but if they seek you help in the deen, it is your duty to help them..” (al-Anfal: 72)

So help them O Muslims!

It is upon the established states in the Muslim lands neighbouring and nearby Somalia (Egypt, Sudan, Djibouti, Eritrea and Saudi Arabia) to materially support Somalia by mobilising their armies.

“If you do not go forth, he will punish you with a severe punishment, and will bring in your place a people other than you, and you will not harm Him in the least...” (al-Tawbah: 39)

· It is upon the Muslim (minorities) living in the surrounding disbelieving states, Ethiopia in particular, to form strong and influential lobbies providing material and moral support to Somalia and holding back these states from fighting Somalia. The Muslims in Ethiopia, Kenya, Rwanda, Uganda and Tanzania are capable of achieving this through active work and effort.

· It is upon the established states in the Muslim lands to break off all relations with America and Ethiopia: embassies, trading of petroleum, treaties etc…and to interact with them as warring states.

In this address of ours, we do not rely on the rulers in the Muslims Lands, for there are mere followers of those who with regard to a believer respect neither ties of kinship nor of covenant. Rather we urge the Ummah; for the armies in the Muslim lands are its sons, and if she is resolute in her petition, her sons will surely answer and give victory to their brothers, removing any barriers in their path:

وَلَيَنْصُرَنَّ اللَّهُ مَنْ يَنْصُرُهُ إِنَّ اللَّهَ لَقَوِيٌّ عَزِيزٌ.

“..and certainly Allah will help those who help His (cause); indeed Allah is Strong, Mighty.” (al-Hajj: 40)

An advice to Muslims working in the financial sector

Assalam wa alaikum wa rahmatullah wabarakatahu, Dear Brothers & Sisters, We are saddened to see Muslims today even those who practise many of the rules of Islam are working in jobs which involve haram in the financial sector. They are working in positions which involve usurious (Riba) transactions, insurance, the stock market and the like. Even though many of the clear evidences regarding the severity of the sin of Riba are known, some have justified their job to themselves thinking that they are safe as long as they are not engaged in the actual action of taking or giving Riba. Brothers & Sisters, You should know that the majority of jobs in the financial sector, even the IT jobs in this area are haram (prohibited) as they involve the processing of prohibited contracts. If you work in this sector, do not justify your job to yourself because of the fear of losing your position or having to change your career, fear Allah as he should be feared and consider His law regard

Q&A: Age of separating children in the beds?

Question: Please explain the hukm regarding separation of children in their beds. At what age is separation an obligation upon the parents? Also can a parent sleep in the same bed as their child? Answer: 1- With regards to separating children in their beds, it is clear that the separation which is obligatory is when they reach the age of 7 and not since their birth. This is due to the hadith reported by Daarqutni and al-Hakim from the Messenger (saw) who said: When your children reach the age of 7 then separate their beds and when they reach 10 beat them if they do not pray their salah.’ This is also due to what has been narrated by al-Bazzar on the authority of Abi Rafi’ with the following wording: ‘We found in a sheet near the Messenger of Allah (saw) when he died on which the following was written: Separate the beds of the slave boys and girls and brothers and sisters of 7 years of age.’ The two hadiths are texts on the separation of children when they reach the age of 7. As for the

Q&A: Shari' rule on songs, music, singing & instruments?

The following is a draft translation from the book مسائل فقهية مختارة (Selected fiqhi [jurprudential] issues) by the Mujtahid, Sheikh Abu Iyas Mahmoud Abdul Latif al-Uweida (May Allah protect him) . Please refer to the original Arabic for exact meanings. Question: What is the Shari’ ruling in singing or listening to songs?  What is the hukm of using musical instruments and is its trade allowed? I request you to answer in detail with the evidences? Answer: The Imams ( Mujtahids ) and the jurists have differed on the issue of singing and they have varying opinions such as haraam (prohibited), Makruh (disliked) and Mubah (permissible), the ones who have prohibited it are from the ones who hold the opinion of prohibition of singing as a trade or profession, and a similar opinion has been transmitted from Imam Shafi’i, and from the ones who disliked it is Ahmad Ibn Hanbal who disliked the issue and categorised its performance under disliked acts, a similar opinion has been tran
